Sometimes a hospital restocks an ambulance with drugs and supplies used while transporting a patient to that hospital. If the restocking is done free of charge, it may violate the federal law prohibiting kickbacks.

Whether a kickback has occurred is not always easily determined. Cash payments given by a hospital administrator to an ambulance company executive so that the ambulance company will direct Medicare or Medicaid patients to that hospital for services are obviously kickbacks. Other types of exchanges between providers, however, also can constitute kickbacks. Any time a healthcare provider gives something of benefit to another healthcare provider, even if it is not a cash payment, and is referred Medicare and Medicaid patients in return, a potential kickback has occurred if the requisite intent to induce referrals is present.

The purpose of this course is to help hospital emergency room directors, pharmacy managers, and compliance officers understand what activities may constitute violations of the anti-kickback statute. The course provides information so you can:

1. Recognize why the anti-kickback prohibition applies to ambulance-restocking programs
2. Determine the factors that may implicate an ambulance-restocking program in the anti-kickback statute
3. List factors the OIG uses to evaluate ambulance-restocking programs under the anti-kickback law
