To encourage a patient care environment that is as free as possible of restraints, CMS has adopted a standard that requires hospitals to adopt and follow strict policies and procedures governing the use of restraints and seclusion in the narrowly defined circumstances where their use is acceptable. A hospital that fails to have in place and enforce appropriate safeguards for the use of restraints risks severe sanctions, including termination from participation in Medicare and other federal healthcare programs.
In comparison with other patient rights standards adopted by CMS as part of the Medicare Conditions of Participation (CoP), the restraints standards are sufficiently detailed to be used by hospitals as a guide or outline of an appropriate set of policies and procedures. However, state laws may also address the use of restraints and, in some cases, may impose standards more stringent than those adopted by CMS. In such a case, the more stringent state standards supersede the CMS standards.
This course introduces you to the standards mandated by CMS to promote and protect the right of patients to be free of medically inappropriate use of restraints and seclusion.
