Substance abuse in the workplace is a serious problem. A carefully planned drug-free workplace policy and substance abuse testing program will help ensure safety and productivity. This course can be used to help keep substance abuse from affecting the safety and productivity of the workplace.

This course will:

1. Look at the problems associated with substance abuse in the workplace and how employers' attempts to control workplace substance abuse create tensions between an employee's right to privacy and an employer's duty to ensure a safe, drug-free and productive place to work.

2. Outline substance abuse testing and drug-free workplace policies; discover what elements employers include in their policies to make them most effective.

3. Look at various legal considerations involved in substance abuse testing. Both state and federal laws come into play, including the federal Americans with Disabilities Act and the Family and Medical Leave Act.

4. Explore your role as a manager in preventing workplace substance abuse by recognizing the signs of substance abuse and working with employees to eliminate its effect on their performance.

After completing the course, managers and training should:

* Have a good idea of what the legal considerations involved in substance abuse testing are, including the implications raised by the Fourth Amendment to the U.S. Constitution and by state laws.

* Recognize how drug or alcohol abuse interacts with the ADA and FMLA.

* Have an appreciation for the balance between your organization's desire to have a safe and productive workplace and the employees' right to privacy, as well as how that balancing differs from public to private workplaces.

* Have a working knowledge of the key elements of a substance abuse testing program and a drug-free workplace policy.

* Have a good understanding of the need for confidentiality throughout the substance abuse testing process.

* Know where to find information on drug-free workplaces and how to provide that information to employees.

* Understand your role in keeping your workplace drug- and alcohol-free, including signs that may indicate that an employee is under their influence.
